General Terms & Conditions
(FOR “BELT SYSTEM”, “MICRO-CERTIFICATION”, AND “TRADITIONAL EXAM” SERVICES )
1. Scope
1.1. These General Terms and Conditions (“Terms”) apply to all online purchases of digital training courses, materials, assessments, and certifications (“Services”) offered by E-Bright via its official website or affiliated online platforms.
1.2. By completing an online purchase, the client (“Client”) agrees to be legally bound by these Terms.
1.3. These Terms form a binding contract between E-Bright and the Client upon confirmation of payment.

2. Description of Services
2.1. The Services consist of digital access to educational materials, online courses, assessments, and certification processing as described on the website.
2.2. Access to the purchased Service is granted automatically after successful payment.
2.3. Unless otherwise stated, access remains valid for twelve (12) consecutive months from the activation date.

3. Fees and Payment
3.1. The applicable price for each Service is displayed on the website at the time of purchase.
3.2. All prices are stated in euros and are inclusive or exclusive of VAT as specified during checkout.
3.3. Payment must be completed in full before access is provided.
3.4. Once access to the digital course has been granted and the Client has expressly agreed to waive the right of withdrawal, no refund shall be issued, including in cases of non-completion or dissatisfaction.

4. Right of Withdrawal (Herroepingsrecht)
4.1. Pursuant to Article 6:230p sub d of the Dutch Civil Code, the statutory 14-day right of withdrawal does not apply once:

the digital course has been made accessible to the Client, and
-
the Client has expressly consented to immediate access and acknowledged the loss of the withdrawal right.

5. Delivery and Deadlines
5.1. Access credentials are provided automatically upon confirmation of payment.
5.2. Certificates are delivered within fourteen (14) consecutive days after successful completion of the required assessment(s).
5.3. Assessment results shall be communicated within twenty-eight (28) consecutive days after course completion.

6. Re-sit Policy
6.1. Belt System: One free re-sit is included. Additional re-sits are subject to a separate fee communicated individually. The Client may purchase a re-sit or repurchase the program if twelve (12) consecutive months have elapsed since activation
6.2. Micro-Certifications and Traditional Exams: Re-sits are not included.

7. Intellectual Property
7.1. All intellectual property rights, including copyrights, trademarks, and database rights, in the course materials and platform content remain the exclusive property of E-Bright.
7.2. The Client receives a limited, non-transferable, non-exclusive license for personal or internal professional use only.
7.3. Any reproduction, distribution, or modification of materials without prior written consent of E-Bright is strictly prohibited.

8. Confidentiality
8.1. Both Parties shall treat all non-public information obtained during the performance of Services as confidential.
8.2. This obligation remains in force for five (5) years after termination of access.

9. Limitation of Liability
9.1. E-Bright’s total liability under these Terms shall not exceed the amount paid by the Client for the relevant Service.
9.2. E-Bright shall not be liable for indirect, incidental, or consequential losses, including but not limited to loss of data, business, or profit.

10. Warranties and Disclaimers
10.1. E-Bright does not guarantee that completion of a course or certificate will result in employment, promotion, or any professional qualification.
10.2. The Services are provided “as is” and “as available.”
10.3. E-Bright does not warrant uninterrupted or error-free operation of the online platform. Temporary interruptions due to maintenance or technical issues shall not constitute a breach of contract.

11. Suspension and Termination
11.1. E-Bright may suspend or terminate access without refund if the Client:

violates these Terms;
-
engages in misconduct; or
-
misuses course materials.
11.2. Upon termination, the Client shall immediately cease all access and use of the platform.

12. Force Majeure
Neither Party shall be liable for failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to natural disasters, war, governmental actions, pandemics, or internet failures.

13. Data Protection
13.1. E-Bright processes personal data in accordance with the General Data Protection Regulation (EU 2016/679).
13.2. Personal data are collected solely for the purposes of course administration, certification, and legal compliance.
13.3. Clients may request access, correction, or deletion of their personal data by contacting E-Bright at the email address provided below.

14. Complaints and Customer Support
14.1. Any complaint regarding the Services must be submitted by email to welcome@e-bright.com.
14.2. E-Bright shall acknowledge receipt within fourteen (14) consecutive days and aim to respond substantively within fourteen (14) consecutive days.
14.3. If a complaint cannot be resolved, the Client may refer it to a recognised consumer mediation body within the Netherlands.

15. Changes to These Terms
15.1. E-Bright reserves the right to update or amend these Terms periodically.
15.2. The latest version will always be available on the website.
15.3. Any substantial changes affecting ongoing access will be communicated by email in advance.

16. Governing Law and Jurisdiction
16.1. These Terms shall be governed by and construed in accordance with Dutch law.
16.2. For business clients, disputes shall be submitted to the competent courts of Rotterdam, the Netherlands.
16.3. For consumers, statutory jurisdiction rules apply, allowing proceedings before the court of the Client’s residence.

Client Acknowledgment
By completing the online purchase and ticking the acceptance box, the Client confirms that:

they have read and understood these Terms;

they consent to immediate access to the digital content; and

they waive their 14-day right of withdrawal once access is granted.
